1. Agreement to Terms

By accessing or using OTTO Automation's services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access our Services.

These Terms apply to all visitors, users, and customers who access or use our AI chatbot services, website, and related products.

2. Description of Services

OTTO Automation provides custom AI-powered chatbot solutions for businesses. Our Services include:

  • Custom AI chatbot development and deployment
  • 24/7 automated customer service capabilities
  • Lead capture and management tools
  • Integration with third-party platforms (CRM, calendars, etc.)
  • Analytics dashboard and reporting
  • Ongoing technical support and maintenance

3. Pricing and Payment

Setup Fees: All packages require a one-time setup fee that covers the custom development of your AI chatbot. Setup fees are as follows:

  • Starter: $399
  • Pro: $899
  • Elite: $2,499

Monthly Subscriptions: After setup, Services are billed on a monthly or annual basis depending on your selected plan:

  • Starter: $149/month (or $119/month billed annually)
  • Pro: $349/month (or $275/month billed annually)
  • Elite: $699/month (or $559/month billed annually)

All prices are in US dollars. Payment is processed securely through Stripe.

4. Refund Policy

Setup Fees: Setup fees are non-refundable as they cover the custom development work required to build your AI chatbot. The only exception is if we are unable to integrate with systems essential to your needs - in such cases, we will work with you to find a solution or provide a refund.

Monthly Subscriptions: You may cancel your monthly subscription at any time with 30 days written notice. No refunds will be provided for partial months. Upon cancellation, your chatbot will remain active until the end of your current billing period.

Annual Subscriptions: Annual subscriptions may be cancelled with 30 days notice. Refunds for the remaining months will be calculated at the monthly rate difference.

5. Delivery and Setup

After payment of the setup fee and completion of the onboarding form, we will build and deploy your custom AI chatbot within 3-7 business days. Complex integrations or custom requirements may require additional time, which we will communicate clearly.

You will receive embed code to install on your website. We provide installation support for all major website platforms.

6. Your Responsibilities

As a customer, you agree to:

  • Provide accurate business information during onboarding
  • Ensure you have the right to use any logos, content, or materials you provide
  • Not use our Services for any illegal or unauthorized purpose
  • Not attempt to reverse engineer, modify, or resell our technology
  • Keep your account credentials secure
  • Comply with all applicable laws and regulations in your jurisdiction

7. Prohibited Uses

You may not use OTTO Automation Services to:

  • Violate any laws or regulations
  • Send spam or unsolicited communications
  • Harass, abuse, or harm others
  • Distribute malware or harmful code
  • Collect personal data without proper consent
  • Impersonate any person or entity
  • Interfere with or disrupt our Services

8. Intellectual Property

Our Property: OTTO Automation retains all rights to our technology, software, branding, and proprietary systems. You are granted a license to use our Services during your subscription period.

Your Property: You retain all rights to your business content, logos, FAQs, and customer data. We will not use your proprietary information for any purpose other than providing our Services to you.

9. Data and Privacy

We take data privacy seriously. Please review our Privacy Policy for detailed information on how we collect, use, and protect your data.

You are responsible for ensuring your use of our Services complies with applicable data protection laws, including obtaining necessary consents from your customers.

10. Service Availability

We strive to maintain 99.9% uptime for our Services. However, we do not guarantee uninterrupted access and are not liable for any downtime due to:

  • Scheduled maintenance (with advance notice when possible)
  • Third-party service outages
  • Circumstances beyond our reasonable control

11. Limitation of Liability

To the maximum extent permitted by law, OTTO Automation shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claims arising from these Terms or our Services shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless OTTO Automation, its owners, employees, and partners from any claims, damages, or expenses arising from your use of our Services or violation of these Terms.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify existing customers of significant changes via email. Continued use of our Services after changes constitutes acceptance of the new Terms.

14. Termination

We may terminate or suspend your access to our Services immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use our Services will immediately cease. We may delete your chatbot and associated data after a reasonable period following termination.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.
